2. Product Information and Pricing

• We strive to provide accurate and up-to-date information regarding our dental equipment, including descriptions, specifications, and pricing. However, we do not guarantee the accuracy, completeness, or reliability of any product information.
• Prices are subject to change without notice. The price displayed at the time of purchase is deemed final, except in cases of typographical errors or technical glitches.
• We reserve the right to modify or discontinue any product without prior notice. We shall not be liable to you or any third-party for any modification, price change, suspension, or discontinuation of products.
• The prices quoted on this Web site do not include GST (Goods and Services Tax), PST (Provincial Sales Tax), HST (Harmonized Sales Tax), or any other sales, use, excise, or similar tax to the extent applicable. All applicable taxes will be charged on each invoice. 

3. Ordering and Payment

• By placing an order through our website, you warrant that you are legally capable of entering into binding contracts.
• Upon placing an order, you agree to provide accurate and complete information required for the transaction, including billing and shipping details.
• All payments shall be processed securely through our designated payment gateway(Elavon convergy). We do not store any credit card information.
• Orders are subject to acceptance and availability. We reserve the right to cancel or refuse any order at our discretion, including but not limited to cases of suspected fraud, unauthorized resale, or violation of these terms and conditions.
• Large Equipment Orders (Over 30kg(66lb))
  Equipment sale terms differ, and convenient financing or leasing is available to approved customers. Call 647-808-5275 for further details. We honour all manufacturers’ warranties. Large equipment will usually be delivered within 6 to 8 weeks. Large equipment orders cannot be cancelled and are non-returnable.

4. Shipping and Delivery

• We endeavor to process and dispatch orders promptly, typically within 2-3 week business days from the date of order confirmation.
• Shipping times may vary depending on your location and the shipping method selected. We shall not be liable for any delays caused by third-party shipping carriers or unforeseen circumstances.
• Risk of loss and title for products purchased from Apex on Tech pass to you upon delivery to the carrier. We recommend opting for shipping insurance to protect against loss or damage during transit.
• Rate Adjustments; For orders exceeding 30kg (66lb), you may be contacted for an additional delivery cost depending on package size and delivery destination.

5. Returns and Refunds

• We want you to be fully satisfied with your purchase. If for any reason you are not satisfied, you may return the item within 2 weeks days of receipt for a refund or exchange, subject to our returns policy.
• Returned items must be in their original condition, unused, and in the original packaging. We reserve the right to reject returns that do not meet these criteria.
• Refunds will be processed within a reasonable timeframe upon receipt and inspection of the returned item. Shipping costs are non-refundable unless the return is due to our error.
• If there are no issues with the product and a refund is requested due to a change of mind or incorrect order, a 25% restocking fee will be applied. Refunds are not available if any damage to the box or item is found.

6. Intellectual Property

• All content, including but not limited to text, images, logos, trademarks, and software, displayed on the Apex on Tech website is the property of Apex on Tech and protected by copyright and other intellectual property laws.
• You are granted a limited, non-exclusive, and non-transferable license to access and use the website for personal and non-commercial purposes. You may not reproduce, distribute, modify, or create derivative works of any content without prior written consent from Apex on Tech.

7. Limitation of Liability

• To the fullest extent permitted by law, Apex on Tech shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the website or purchase of dental equipment.
• In no event shall our total liability to you exceed the total amount paid by you for the purchased products giving rise to the claim.

8. Governing Law and Dispute Resolution

• These terms and conditions shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada.
• Any dispute arising out of or relating to these terms and conditions shall be resolved through negotiation in good faith. In the event of failure to reach a resolution, the dispute shall be submitted to binding arbitration in accordance with the rules of the ADR Institute of Canada.
